How to Obtain Marriage License
DeKalb County
Location:
DeKalb County Courthouse, Judicial Tower, Room B190 (basement floor)

General Information:
Georgia residents may apply for a marriage license in any county in Georgia. If neither applicant is a resident of Georgia, the marriage license must be obtained in the county where the ceremony is going to be performed. The marriage license is valid only for ceremonies performed in Georgia. Premarital blood tests are no longer required in Georgia.
Requirements for Marriage License:
Both applicants must be present in order to obtain a marriage license. You must provide proof of age. Documents that are accepted include, but are not limited to, a valid driver’s license, original or certified copy of birth certificate, valid passport, or valid armed forces identification card. See O.C.G.A. § 19-3-36 for more information. You must be at least 16 years of age to obtain a marriage license. If you are 16 or 17 years of age, parental consent is required. See O.C.G.A. § 19-3-37 for more information. If either applicant has been divorced, you must present a copy of the final divorce decree(s). If either applicant presents a legal document in a language other than English, the applicant must attach a translation of the document by a certified translator.
Fees for Marriage License:
Without Certificate of Premarital Education o The fee is $56.00. With Certificate of Premarital Education, the fee is $16.00. A signed and dated certificate of completion from a qualifying premarital education program with at least six hours of instruction must be provided. Certificate of Completion of Qualifying Premarital Education form is available on the DeKalb County Probate Court website. See O.C.G.A. § 19-3-30.1 for more information about premarital education.
Forms of Payment:
Cash, certified check, or money order is required. Certified checks and money orders should be made payable to DeKalb County Probate Court.The court does not accept personal checks, credit cards, or debit cards. All fees are nonrefundable.

The fee for a certified copy of a marriage certificate is $10.00. The fee for a certified copy of a marriage license application is $10.00. If a divorce was granted, for either party, within 30 days of applying for a marriage license, then the party must provide a copy of the divorce decree.
Cost:
There are two sets of fees for marriage license applications.The fee is either $56.00 (without certificate*) or $16.00 (with certificate*). The application fee is waived when the couple seeking the license has completed a qualifying premarital education program. A certificate of completion of a qualifying premarital education program in accordance with Code Section 19-3-30.1 must be presented for the $40.00 application fee to be waived. Other fees and costs still apply. See below.

Applicants under 18 Years of Age As of July 1, 2019: You must be at least 17 years of age to obtain a marriage license in Georgia. If you are 17 years of age when applying for a marriage license, you must show that you have been emancipated for not less than 15 days, and present a certificate of completion of separate specialized premarital counseling for each applicant, even if one applicant is over 18.
Any Georgia resident may apply for a license in any county in Georgia. However, if neither applicant is a resident of Georgia, you may only obtain your license in the county where the ceremony is performed. The license does not have an expiration date.
Both parties must be present in order to obtain a marriage license. Pre-marital blood test results are no longer required in the State of Georgia.

A list of officiates available to perform a marriage ceremony is posted on the information board located in the Probate's office. Please read the following law pertaining to current judges:
Georgia Code Ann. 19-3-49. Acceptance by judges of tips, considerations, or gratuities.
In addition to any compensation otherwise provided by law, any judge who performs a marriage ceremony at any time, except normal office hours, may receive and retain as personal income any tip, consideration, or gratuity voluntarily given to such judge for performing such marriage ceremony.
The following items are required to apply for a Marriage License:
Beginning July 1st, 2005, all persons planning on applying for a Marriage License may successfully complete a Qualified Premarital Education Program. This program must include at least 6 hours of instruction involving marital issues, which may include, but not be limited to, conflict management, communication skills, financial responsibilities, child and parenting responsibilities, and extended family roles. The premarital education must be completed within 12 months prior to the application for a marriage license and the couple must undergo the premarital education together. The premarital education shall be performed by:

The premarital education shall be performed by:
- a professional counselor, social worker, or marriage and family therapist who is licensed pursuant to Chapter 10A of Title 43;
- a psychiatrist who is licensed as a physician pursuant to Chapter 34 of Title 43;
- a psychologist who is licensed pursuant to Chapter 39 of Title 43; or
- an active member of the clergy when in the course of his or her service as clergy or his or her designee, including retired clergy, provided that a designee is trained and skilled in premarital education.
